Spanish certificate of last wills

In a succession involving Spain, it is often necessary to verify whether the deceased made a will in Spain. The Spanish certificate of last wills makes it possible to obtain this information and, where applicable, to identify the notary before whom the will was executed.

What the document certifies

The certificate makes it possible to determine:

  • whether a will has been registered in Spain,
  • the date of the will and the notarial office concerned, where a will exists.

In which situations it is required

This document is used when it is necessary to:

  • verify the existence of a Spanish will,
  • secure the subsequent succession formalities,
  • avoid initiating a procedure based on incomplete assumptions.

Conditions for obtaining the certificate

The certificate is issued upon presentation of:

  • a Spanish death certificate, or
  • a multilingual death certificate issued by another Member State of the European Union.

The practical arrangements depend on the competent authority and the place where the application is made.
