The Spanish sales agreement does not make the signature of the sale before a Notary conditional to obtaining a bank loan, even if the purchaser is a private individual and he/she resorts to a mortgage loan. On the contrary, we often find a penalty clause. The purchaser who withdraws loses the deposit paid. The seller who withdraws must pay twice the deposit received.
